Frequently Asked Questions

Clear answers to help you navigate the Winnebago and Adams County probate courts with confidence.
Do I need a lawyer to set up a trust fund?

While you can technically find DIY forms online, they often fail to comply with the specific requirements of the Illinois Power of Attorney Act or the Illinois Probate Act of 1975. A local lawyer ensures your trust is legally binding, properly funded, and tailored to your family's specific tax situation to avoid expensive disputes later.

What does a probate lawyer do?

A probate lawyer guides the court-supervised process used to verify a will, pay off a decedent's debts, and distribute the remaining assets to heirs. In Winnebago and Adams County, this includes filing petitions with the Circuit Clerk, notifying creditors, and petitioning the court for final distribution.

What happens if you don't have a will?

If you die without a will (intestate), the court will appoint an administrator to manage your estate instead of an executor you chose. Your assets will be distributed according to Illinois state law rather than your personal wishes, which can lead to unintended consequences for your surviving family members.

What kind of lawyer helps with wills?

An Estate Planning attorney is the specific type of lawyer who helps draft wills, trusts, and powers of attorney. Working with a local specialist in Rockford or Quincy ensures your documents follow local court rules and reflect current Illinois statutes.

What is the order of inheritance without a will?

When someone dies without a will in Illinois, the Illinois Probate Act dictates the order of inheritance. Generally, assets are split between a surviving spouse and children; if there are none, the estate moves to parents, siblings, or more distant relatives. This rigid structure often ignores the specific needs or dynamics of modern families.

How to protect your estate from probate costs?

The most effective way to protect your estate is to avoid the Winnebago or Adams County probate courts entirely. You can achieve this by using a Living Trust, "Transfer on Death" (TOD) instruments, or joint tenancy. These tools allow assets to pass directly to heirs, saving them the 3% to 7% in total estate value typically lost to probate expenses.
